How much is the Overstaying Fee for Tourists in the Philippines?
Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.
This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.
If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.
These combined penalties and fees can add up over time and can be something like the following figures:
I have calculated the following approximate costs for overstay payments including Visa Fees, ACR cards and Penalties.

Note: These are approximate costs. Immigration will determine the exact cost when you visit their office.
A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.
These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.
Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:
The minimum penalties appear to be:
- All Visa Extension Fees not previously paid.
- Fine for Overstaying – (additional) Php 500.00 per month
- Motion for Reconsideration for Overstaying – (additional) Php 500.00
I have read that the Overstay fee for just a few days would be about 4,000 pesos.
This would be the 3,030 peso first Visa Extension fee + Overstay Fees. (2015 fees)
If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:
3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying
If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION. The fee would be made up as follows (assume figures for 13 months):
3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee
That is my guess, based on the actual costs for Normal Visas last year. If anyone has paid an Overstay Fee, please give details in the comments box below, showing the date and the fee paid and the total days overstayed. Thank you.
The Official Statement for Visa Extensions is:
Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.
The said periods shall be counted from the date of applicant’s latest recorded arrival.
Overstaying Foreigners in the Philippines
Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.
Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I went with an online visa service which turned out to be a scam they scanned me for 60k peso no visa lying bastards so now I learn my visa expired I’m so paranoid that I’ve thought about kayaking from Palawan to the tip of Malaysia lol but I need to know can I just pay the fines and leave I don’t want to stay I want to leave this hell hole…ive been robbed scammed used and Im so fustrated !
I am pretty sure they are normally lenient during the COVID times, so you need to get to an office when you can, and sort it out.
I did read that you need to apply for an extension within 30 days after the lockdown is lifted. Otherwise normal rules apply, fines etc.
That should mean you just pay the fines, and leave.

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.
Hi, Admin. My visa expired on the 19 September 2016. I would like to settle my outstanding penalties and leave the Philippines. I have committed no offences. Having read your article, I am assuming to pay around 60k for penalty charges. I would to know in the event I settle the outstanding charges, will I be deported and how is that process? Unfortunately, no one can be sure what will happen. Deportation is of course an option open to anyone who overstays a visa, although not everyone is deported.
Hi there, I have overstayed here in PH since the 28th of jan 2018, i lost all my money to my ex girlfriend. I moved from mindanao to where i am now in Olongapo. Iam now just over 5 months late paying my extension. I had bad advice from other forigners saying its no problem being several months late, just dont go over 12 months. After several months i thought to myself this cant be right. So i did some research and thought as i now have my finances back in order i better go pay. I went to the olongapo imigration, filled out all the forms, wrote the reasons why ive overstayed and yet in the intervieww i was denied an extension, i was told my reasons were not vaild, the guy there never even looked me in the eye. Denied my visa and told me to go to manila and apply there. This is where the confussion is. Surely if im denied why did they not detain me there and then? why give me back my passport and let me leave? I am now really worried. I am going to go Manila tomorrow to extend. Did he send me there because he was in a bad mood, didnt want the paperwork, or thought i would go there and get deported easier? I really dont know. Have you heard of such a thing before. Any info before tomorrow would be very helpful.

Please i need your advise, as i’m married here in the Philippines and my tourist visa is due to expire on the 15th of July and my passport would expire by 28th of November 2018, which implies 4months validity. I have tried numerously to renew my passport from the moment it remained 6months to expire, but my embassy only process passport renewal applications twice yearly i.e January and July.
I have gone to the Angeles city Immigration office but they insisted i can’t be permitted renewal unless i obtain a new passport. What do you suggest or advise i do as my embassy is fully consented.
Secondly, what’re the requirements for applying for a TRV visa or any recommendable visa by your good and kind self? As i’m legally married with a filipina and all our kids possess Philippines citizenship as well and what the cost for the visa could approximately be.

You say that your embassy process passport renewal applications in July.
It seems you need to push for that quickly.
Explain the situation to your embassy.
Get something in writing from your embassy about when the passport will be ready. Then take that to Philippines Immigration and see what they can do. It at least tells them what is happening if they are unable to renew the visa until later, ie: once you get a new passport.
Ask immigration at the same time about getting a marriage visa, so you can get that started as soon as you can.

Coincidentally, i’ve just received a mobile SMS alert from my embassy at about 6pm this evening to appear at the embassy on the 19th of July 2018. Which means i would be on 4days overstay by then, but they’re agreed to issue a memo addressed to the BOI so as to subside any possible penalties on my case upon issuance of the new passport. Meanwhile, I’ll embark on it ASAP with no further delays.

extended my 30 day free stsy to 59 days and was due to return to bi office on or before 10th june to extend a further two months and to purchase ACR card however for peronal reasons i was unable to be there . plan to gp on 9th july to pay extension fee, acr and the fine. around 7000 for 2 month extenson anf card but how much extra for my penalty/fine. need to prepare the money so i know. on 9th july i ll be overstaying a total of 28 days (june shorter month)

I am a US citizen, arrived in Manila August 2, 2017. I applied for a Philippine-dual citizenship quite late and still waiting for the certificate (approved application). Since my stay in the Philippines will be one year this August. Will you advise me to leave the Philippines in order not to be penalized? If your application is approved, then there should not be an issue with citizenship.
However, if you travel out in the future as a US citizen, using a US passport, it is highly likely you will have issues with immigration at that time.
Try and leave on a Philippine passport, to the US or other visa required countries, and they would refuse boarding.
Try to leave on a US passport and they would refuse boarding due to no valid visa and ECC.
Most people keep renewing a visa.
I assume you have a Balikbayan visa, and if you can leave and return on a new one, it could be cheaper to do that, than 12 months of visa renewals each year.
It would be best if dual citizens were allowed to use both passports to avoid these issues.
I have heard that some people do manage, but bothers are not allowed.

i am foreign student in vigan. i have 8 month visa penlty. and they told me to pay admin fine which cost 70000. should i have to pay this fine for penlty in student visa extention.
Student Visas appear to be different to Visitor Visas, for costs and penalties.
I have seen that there is Penalty of Php20,000 applying to international students who enrol for the term without a valid student visa.
At 8 months, that could be three terms, and that alone would be 60,000.
I will have to check on the Student Visa fees, and specific penalties.

Just 2 weeks over should not be a problem, not much more than the normal renewal fee, maybe an extra 1,000 pesos. So 4 or 5 thousand pesos should be right.

My boyfee Came with a proposed student visa from nigeria last year August which was supposed to be extended after 3 months or so. But he failed to do so, he has not enrolled in any school yet, he has currently not renewed his visa & so will be termed an overstayer.

It needs to be paid at an Immigration office, the same one that issues visas. The payment covere all unpaid visa fees plus the penalty.
The figure for 19 months is about 50,000 pisos.

When you pay the penalties ask for an ECC at the time, so you can book a flight.
Immigration may impose a ban, but you can explain what happened and see if they give any leniency.

As an illegal alien, if you try to pay at the airport they will probably refuse boarding, and send you to the Immigration office in the city.
You should go and renew the visa ASAP.
The cost will depend on how long you have stayed in total, if you need an ACR-I card, and an ECC, etc.

You need to check this with an immigration office. As soon as you can.

If they travel on a foreign passport, they are normally treated as nationals of the passport country.
Consequently they need to renew the entry visa, at an immigration office, before leaving. Any penalty will be charged at that time.
If they try to leave, on a foreign passport, they will most likely be refused boarding and told to go to an immigration office to rectify the visa issue.
It is best to do this well before any intended flight.
The ideal option is to do it before the date that the current entry permit/visa expires.

First of all high 5 to Admin…you have a great resource and you believe in follow up as well. Great Job. FOR THE MANY PEOPLE THAT ARE SCARED DO NOT LET WORRY AFFECT YOUR HEALTH. Just focus on what you can control. The US embassy will give you a loan and plane ticket if you have relatives that will receive you. And you must pay it back when you can. But long fees they will not pay ..For the people that are scared to go to immigration just go to a Travel Agent in the mall somewhere they know how to calculate the latest fees. You do not have to give them your IDs you are just asking questions. But of course they will be thinking whats in it for them so of course they will add their own fees if you would like them to process for you. Of course have to be careful with that. Many will frown on overstayers and think they are taking advantage and they are clueless some are stranded and trapped I understand it. Thanks to Admin.

But, it depends on the immigration officer at the time.
The normal treatment is to pay for a 1 month renewal, plus penalty. About 4,000 total.

By becoming illegal with even a one day overstay, the penalty fees normally apply, and they would usually charge the minimum visa renewal fee plus penalty, so about 4,000 pesos. It may be more if an ACR-I card becomes a requirement (normally after 59 days).

The US embassy won’t deport him.
It is the Philippines immigration that deal with overstay penalties and deportations.

There is never a guarantee.
Philippines Immigration can be pretty hard on illegal aliens, if they want to use the law to the full.
Being illegal for 4 years is a big risk.
As you are tight on the funds available, and being so close to the estimated amount needed, I would suggest checking in with your Embassy first. They may be able to assist if things go wrong for you.
They wont help, at all, they said i just need to go there myself, embassy is of no help.

From what they have quoted, 120,000 is about right for 4 years.
However, one thing we learn in the Philippines is that nothing is ever straightforward.
I would feel safer with extra, but it may be best to just go and see what happens, rather than keep putting it off and making it worse.

If he is married in the Philippines and he has an ACR 13A vIsa he pay for 7 years 14000 Peso penalty if he go to the Immigration office with a valid passport,if the ACR is expiered again 2500 Peso extra plus application fees.If he was sick and not able to travel for 7 years and has no ACR (and even he have a ACR) I suggest strongly bring a medical certificate from a good doctor to the Immigration office .
Good evening sir. I’m a Canadian citizen who was born in the Philippines. I entered the Philippines last May 5th and was supposed to leave June 5th. Unfortunately I got sick the day before my flight and have now forfeited my return flight. I’m now planning to extend my stay up to mid July at the latest. I read somewhere that former Filipinos can stay for up to a year, provided they have a PH passport or NSO Birth certificate. Is this information accurate? The one year allowance that you mention is the Balikbayan visa.
The Philippines’ BALIKBAYAN PROGRAM allows a one-year visa-free stay for Filipinos working overseas and for former Filipinos who have acquired citizenship in certain countries.
Visitors who are admitted as Balikbayan are given an initial stay of one year. This can be extended, in the same way that normal visas can be extended.
I am under the impression that this one year Balikbayan visa must be requested on entry. It may be worth asking at your nearest Bureau of Immigration, as soon as possible, to allow time to renew your visa ASAP if you need to.

It would appear that you do have the balikbayan 1 year visa stamp.

You mention they are allowed a one year stay. That only applies if they were given one year visa on entry. Otherwise it is one month only.
That would be shown in the passport.
You need to see the date of permitted stay in the passport and work out the months to the current date, to check the overstay period. The cost can then be estimated from the figures in this article.
Dear admin. One of my friend had submitted passport for student visa extension to our college visa incharge people. But our college visa incharge people didnt submit the passport immidietly to the immigration office even though they were knowing that visa is about to complete 6months in a week. Even though we submitted passport for visa extension before completing 6 months our college visa authority delayed in submitting. You should go to an immigration office and get help from them. Take whatever proof you have of the situation, to show you have done what you thought needed doing.

Hi admin, i would like to come in and pay for my 3 years over stay, would it be possible if i go in and ask how much i would have to pay for my fees first and penalties, then come in within a week and pay for it? As a natural born Filipino you should apply to resume your Filipino citizenship, assuming you gave it up, or lost it, at some stage.
It’s only if you plan to travel on a US passport that would involve problems with overstay.

Under one year would not normally result in a blacklisting.
HI Admin thanks for the information i just have one last question as i said i am from the Uk so i got 59 day Visa when i arrived.. so as it stands am i 10 months OVERDUE or a year? as
the first 59 says i was allowed to stay i came here with of June last year..so i have only stayed 10 months longer then i am allowed is that right? or do they count from the day i landed?

It is from the date your visa expired, and you became illegal, so just 10 months by your dates.
Hi admin, i am natural born filipino but my citizenship is american i already lived here for 20 yrs i don’t have visa and my passport is already expired since 2001 how much am i going pay?
As an American citizen you have technichally been an illegal alien for 20 years. The cost for that would be way too high: 600,000 by normal calculation.
But as Philippine born, presumably to Filipino parents, you should be able to claim Philippine citizenship.
I suggest getting Philippine citizenship.

If he travels on a foreign passport then a 3 years overstay is about 90,000 pesos.
This can be avoided by travelling on a Philippine passport. But of course that only works for travelling to a non visa required country.

You can possibly apply for citizenship, but you are probably classed as an illegal alien if you have no current visa to be in the country legally.

We were originally booked to stay here in the Philippines for 2 weeks only but due to an unforeseen medical emergency we will now need to stay for over a month. My son has a british passport and will therefore exceed his 31 day allowance. Will the overstay fee be waivered due to this unplanned emergency? Also if we will need to pay, how much will it cost as his extended stay will only be for maybe 3 weeks? Thanks!
Yoy just need to renew the visa, before it expires, to avoid any overstay complications. Just do a one month extension renewal.
You either go to an immigration office before expiry, and get it done, or you go to an immigration office after expiry, and get it done, and pay extra.

She was born in Toronto when I was a Permanent Citizen in Canada but I am currently a canadian citizen here. She is going back in Canada in August. 8 years of overstaying. How much should he pay for her overstaying. What is the best remedy for her to lessen her tax fee.
8 years overstay is around 250,000 pesos.

Then she could leave the Philippines via a non visa required country, on, Philippine passport, and then fly to Canada from there, on a Canadian passport.

Hello admin. My sister had a foreign boyfriend and he lived in our house for almost 2 years. We didn’t even know if he is paying for his visa here in the Philippines. My concern is how did we know if he is really paying or not? And if he constantly paying it, there is a possible or it is possible that he can stay over a time?
Without asking him, it would be difficult to know for sure.
It does seem that many do overstay, and then have to pay it all, plus penalties, when they leave. They also face a ban on future visits.
Everyone on visitor visas need to leave after a maximum of 3 years in the country. Some need to leave after 2 years.
Thanks admin. Since he is not telling us about his status of his overstaying and he just told us that he is paying for his penalties. In our part, we would like to confirm how true it was that he was paying the penalties . Is it possible to know about his status of overstaying without his knowledge? We are just concerned and worried of his situation. Moreover we don’t have any idea about his overstaying and what will be the outcomes for that and for our family that it seems we hide him.
It seems you have suspicions about him. You could go to an Immigration office and ask them. You would need as much information as possible, his full name, date of birth, nationality, passport number would be handy. I am not sure if they would do anything, although they may be able to check.
Very few people worry about this, and a Filipino wold not be in trouble, as you are under no obligation to check a persons visa issue. If he says he is up to date, then what choice do you have, but to accept it.
If he isn’t up to date, it is him that will have to find the money when he wants to leave, to pay all the outstanding visa fees + penalties.
Immigration do have details on everyone in the country, the date they arrived and left, and their visa status. They do not know where each individual is staying, so are unable to do anything about over-stayers until they try to leave.
If your suspicions are of concern, then I would suggest asking at your local Immigration office. But be prepared for any consequences, should he find out that you did that. They might tell him.
