How much is the Overstaying Fee for Tourists in the Philippines?
Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.
This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.
If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.
These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs. Immigration will determine the exact cost when you visit their office.
A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.
These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.
Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:
The minimum penalties appear to be:
- All Visa Extension Fees not previously paid.
- Fine for Overstaying – (additional) Php 500.00 per month
- Motion for Reconsideration for Overstaying – (additional) Php 500.00
I have read that the Overstay fee for just a few days would be about 4,000 pesos.
This would be the 3,030 peso first Visa Extension fee + Overstay Fees. (2015 fees)
If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:
3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying
If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION. The fee would be made up as follows (assume figures for 13 months):
3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

The Official Statement for Visa Extensions is:
Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.
The said periods shall be counted from the date of applicant’s latest recorded arrival.
Overstaying Foreigners in the Philippines
Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.
Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I went with an online visa service which turned out to be a scam they scanned me for 60k peso no visa lying bastards so now I learn my visa expired I’m so paranoid that I’ve thought about kayaking from Palawan to the tip of Malaysia lol but I need to know can I just pay the fines and leave I don’t want to stay I want to leave this hell hole…ive been robbed scammed used and Im so fustrated !
I am pretty sure they are normally lenient during the COVID times, so you need to get to an office when you can, and sort it out.
I did read that you need to apply for an extension within 30 days after the lockdown is lifted. Otherwise normal rules apply, fines etc.
That should mean you just pay the fines, and leave.

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

I assume you have had visas for that 3 years.
I am actually not sure what happens when someone goes past the 3 year limit.
If you have a valid reason, and are up to date with visas, you may get away with it.

Yes. People who have not paid their visas need to pay them up to date and penalties on top, before being allowed to leave the Philippines.

Hi! I gave birth to my baby in the US and I took him home here in the Philippines. I am just a tourist visitor in the US when I gave birth on him. We came home last May 5, 2017, he was given a one year to stay here. If We travel for a week outside the country, will I be able to bring him back again here? He still does not have a philippine passport. Do I need to Register him in the Bureau of Immigration? I already got him a Report of Birth in DFA and registered his birth certificate in PSA. If the child travels on a US passport you can expect all rules that apply to foreigners to apply.
You should arrange a Philippine passport as soon as you can, or ensure a new visa is applied for before the existing one expires.
If you both leave and then return, you can get a new visa on re entry. It may be another Balakbayan visa or a 30 day one that needs renewing.

It depends on Immigration. I believe they may have some leeway on this, depending on the circumstances.
Over 12 months is worse, so get in fast, before the 12 months overstay without a visa is reached.

You can call them, or you could go into an BI office on his behalf and ask.
A 2 year overstay is about Php60,000, but deportation and blacklisting may be decided at the local office.
In your situation, it might be best if you go in yourself, and ask, and specify your relationship etc., to try to avoid deportation. Then go back with him, and see the same person, assuming they give you a positive result.

Hi i have questions for my cousin who is canadian and went to the phillipines at age of 2years old with his mom. He is now 19 years old and wants to go back to canada. Due to financial problem and other burdens his passport was not renewed until now. He wants to go back to canada so he can help his mom out and he is not able to get a proper job or go to school in the philippines. What should he do?will he be deported or pay fines?how much?
The backdated visa costs and fines would be very high, maybe around 500,000 pisos, for an effective 17 year overstay, and deportation and blacklisting.
Does he also hold Philippine Citizenship, or can he get it? That could get around that cost, by getting a Philippine Passport and being able to leave to a non-visa required country, without having to get involved using a Canadian passport to leave.

Hopefully this will help you guys. I have overstayed my visa for some years now since I was 12 and my parents never realized the importance of renewing the visa and avoiding overstay. Just now I got to take care of it on my own. I went to the
main immigration. Guys I do advise avoid overstaying your visa more than 12months or you’ll have a hard time and you will be blacklisted. Since they saw me come in with my daugther, they said it can be a ground for reconsideration and they had me submit her birth certificate (which is a Philippine one) to hopefully have them reconsider my blacklisting. So I was born in Japan, so I was japanese citizen, then went to philippines with my parents till I was 23. My parents divorced later on (my dad being full japanese and my mom filipino). We later found out that my father had not been paying my stay in the philippines since I was 10 yo but he did for both my sisters. At 23yo, I went to back to Japan for work. I tried applying for a passport to go to other countries to visit my boyfriend, but got denied because I was blacklisted in the Philippines.

There is no guarantee, but I think that more people are not deported than are. It is of course possible. And the longer you leave it, the worse the possibilities.

He have all the requirements for his school but the thing is, it hasn’t authenticated yet. The schools/university advised him to get it authenticated so we decided to go to the Immigration. They said that it needs to get done from the country where he came from. Unfortunately we failed to accomplish everything before June. So we just agreed that he’ll enroll on November 2017 for the second semester. But still didnt make it due to his unauthenticated paperworks. We had to send it back to his mom and do it in America. You say that he arrived in Manila in April 2017. How long has he been illegal, without a visa?
You should see Immigration ASAP, and get a visa sorted and pay any overstay fees.
They may refuse a student visa based on him being in the country illegally if he applies while being, as they call it, an illegal alien.
Under 12 months overstay does not normally incur deportation or blacklist.

I doubt that you are on a tourist visa then.
I have no idea on the refugee visa system, but I would assume they will be treated differently, with no penalty. However, it may be best to go and check with an Immigration office.

I would suggest he tries to get financial aid from his family, maybe even asking his Embassy if they can assist him.
It would be best to do something soon before it gets too difficult.
The visa costs will just keep accumulating, and will need paying, with added penalties, before he can leave.

Jail is an option, although I am not sure how often it happens.
You could ask about a discount, although I doubt if it would be available.
The British embassy do help people with Medical issues. It might be worth contacting them if it is serious.
I had a student visa but it has expired. I have overstayed one year now but will be getting married with my fiancee and was wondering if ill be able to stay with a residence visa. There are no guarantees.
You need to be ready with a good reason for not following the laws and staying without a visa.
Many people do get away with just the financial penalties, and you will probably be the same, but there is always the chance of a blacklist. But going in and paying the outstanding fees etc, without creating trouble, will make it easier for them to just allow you leniency.

With a Philippine parent the Dual citizenship should be no problem.
He can then travel on a Philippines passport with no issue.
If he tries to leave on a foreign passport then there may be issues, as a foreigner needs a visa.
Some have said they had no issues when they show both passports, but others still had issues.

Visa extension is done at any Bureau of Immigration.
Philippine citizenship is also possible, if Greece allows Dual Citizenship.

If he hasn’t sorted it out before getting to the airport he may be refused boarding and sent away to an immigration office to sort it out.

Under one year should be OK. Deportation is normally only for overstays over 1 year.
Go to the nearest immigration office as soon as possible.

For her to travel to the US, she will need a current US passport.
To leave the Philippines using a US passport may easily create overstay issues.
If she also has a Philippines passport, she could travel to Hong Kong or similar, with no issues, and then fly from there to the US.
That avoids any overstay issues or penalties.
Regarding time for documents, I don’t know what documents you might need.

What I want to know is would immigration give me another extension so I don’t have to leave so close after our child is born? I have to go get a visa every 6 months to stay I don’t know if I am under the 2 or 3 year visa. How can I tell what visa I have? I don’t qualify because of the cost. A one year overstay gets close to a possible deportation and blacklist for the future.
Only immigration can decide. I suggest going to an immigration office immediately and getting the visa up to date.

I am pretty sure you will have to pay the penalties.
They may also take account of you breaking the law for 7 years, when assessing your citizenship application.
Personally, I would get everything up to date before even applying.

Bye mistake (and mistake including 29 days extension with December and January is 31 days, that’s makes me 1 day 1hour short ) my first month extended visa is ending 4th February, and my flight 1am in sixth of February, but I should be inside at 5th to catch the flight
My question is even my flight 1am at sixth , can I pass passport control at 4th, and wait inside 24 hours like transfer waiting
My other question is, if I can’t do that, can I buy one way thicket somewhere in January and pass the passport control, but not fly anywhere and go back inside the Philippines by passing passport control back in to get new one month visa , is there any rule about that, such as staying out for 1 day,

There is the possibility that you will be told to go back to the nearest immigration office and renew.
I do suggest asking at an immigration office, for clarity. And get any positive answer in writing..

We have a visa for one month, till 26th January. But we made a mistake by booking our flight, we booked the flight 6:45 on 27th of January. This means we can check in around 4:00, so our overstay would be 4/5hours!…. We tried to replace the flight to 26th but this will cost us 5500P. Do you think the border security will fine us for this 4/5hours overstay (how much)?
Otherwise we have to extend our visa for 4/5hours…..

Some airlines have stricter rules on that, than others. You need to ask the airlines, or a travel agent.

I actually just got back from the Bureau of Immigration. I am an Fil-Am and have over stayed for about 7 months. Your aunt is NOT be allowed the leave the country. Since her US passport is expired AND has to pay the penalties. I hope your aunt is ready to come back at least 3x times to the BI because that’s what they did to me. 1- Renew her US passport because BI would basically see her as an undocumented alien here in the PH (if she is in a hurry to leave, she can choose to ” express ship ” her US passport . 2- once she received her US passport, show up at the BI, they will ask for both her old and new passport, they will calculate her penalty fees for her over stay. I paid 15k PHP for my penalties. Good Luck to your aunt.

2 weeks late is not too bad, it is only going to be the normal visa renewal cost plus an extra 1,000 or 2,000 for the penalty.
The visa cost depends on how long he renews for: 1 month, 2 months or 6 months.

From the figures above it looks like around 120,000 pisos.
Not paying is not an option for most people, but I have heard that a persons embassy can sometimes help, although re entry may not be possible if it isn’t all paid.

You should not get deported, but get it resolved as soon as you can. Do not let it reach 12 months.
Ask at immigration, explaining the dual citizenship aspect, and see what your best course of action is.

They arrive and get a visa on arrival for 1 month. Then, in that first month, they apply for a visa extension for each of them. This avoids any overstay fees and fines. Make sure to renew all visas.

If your child fits for dual citizenship or recognition as a filipino citizen, his fees will be waived and all you have to pay is the processing fee for your application.
