How much is the Overstaying Fee for Tourists in the Philippines?

Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.

This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.

If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.

These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs Immigration will determine the exact cost when you visit their office.

A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.

These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.

Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:

The minimum penalties appear to be:

  • All Visa Extension Fees not previously paid.
  • Fine for Overstaying – (additional) Php 500.00 per month
  • Motion for Reconsideration for Overstaying – (additional) Php 500.00

I have read that the Overstay fee for just a few days would be about 4,000 pesos.

This would be the 3,030 peso first Visa Extension fee + Overstay Fees.  (2015 fees)

If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:

3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying

If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION.  The fee would be made up as follows (assume figures for 13 months):

3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

That is my guess, based on the actual costs for Normal Visas last year.  If anyone has paid an Overstay Fee, please give details in the comments box below, showing the date and the fee paid and the total days overstayed.  Thank you.

The Official Statement for Visa Extensions is:

Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.

The said periods shall be counted from the date of applicant’s latest recorded arrival.

Overstaying Foreigners in the Philippines

Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.

Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I arrived here in the Philippines during the heat of the covid 19 pandemic which seemed like everyday a lockdown, I wanted to extend my visa but was unable to travel 5 hours away due to lockdowns and being told I would have to quarinetine for 14 there and once I got home which was insane! I have been here for 14 months expired visa I want to pay the fines fees and bring my visa up to date! I went with an online visa service which turned out to be a scam they scanned me for 60k peso no visa lying bastards so now I learn my visa expired I’m so paranoid that I’ve thought about kayaking from Palawan to the tip of Malaysia lol but I need to know can I just pay the fines and leave I don’t want to stay I want to leave this hell hole…ive been robbed scammed used and Im so fustrated !

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

I’m a Filipina and I gave birth to my daughter in US month of May 3013. My daughter came in the Phil with US passport in Nov 2013. I applied for her NSO birth certificate and was able to obtain her Phil passport Feb 2017.
Qn is:
Does having Phil passport will help her travel without paying fines for overstaying cos I was informed that dual citizenship has to be applied and until she is recognized, she must pay visa extension fees because the recognition is not retroactive. She would have a problem leaving the Philippines because she would be considered an overstaying alien.

Hello, i have overstayed my 36 months due to the covid outbreak and have had 4 flights cancel on me. I wasn’t able to do a visa run because they aren’t issuing visas upon arrival anymore. I have been here since Apr 2017 and have paid all of my extensions up until Apr 2020. I filed for a motion of reconmmendation of overstay which took 5 months to get back to me. I have now been stung with a fee of 15,000php for the fine and a further 10,000 for the express lane. I don’t mind paying the fine as that was expected but why 10,000 for the express lane when it has taken so long to come through? Also i thought the express lane was only around 1,000 php. Plus then i have to pay for the fimal month they will give me to leave the country so it’s looking more like 30,000 with the ECC too. Why so much for express lane?

Sir, I have to visit philippines as soon as possible, so i took singapore tourist visa and came to the philippines on on arrival visa on June 1st which granted 14 days permission and again i went to bureau and extended it for a week and one agent finally extended for a month upto july 22, 2018. So from that day to now i don’t have visa which is May 17,2019 approximately 10 months now. I am on on arrival visa only and I am a student now and i have to go to India, i have been fooled by my agent. I was a Japanese-Filipino when I came to the Philippines. I was pregnant at that time. But before I gave birth, I’ve chosen Japanese as my citizenship and withdrawn my Philippine citizenship at Japanese Embassy.
I wasn’t aware of the law and thought my child is a Filipino. I just read other posts, and I want to add that he is not beyond the maximum allowable period, he is still less.

I read he needs to do a motion of reconsideration, is this done the same day, or do they take the passport and you have to wait several days to know if it is accepted?
Does he need to give written detailed reasons why he overstayed?

Thank you. I have seen this too, but there is no mention what happens if overstay is less than 12 months, and he has NOT been in the country beyond the maximum allowable period, but is still within this period.

I just check his passport and see it is expired already one year. What to do? If he renews passport now, he will be more than 12 months overstaying until he gets new one.

Ive been in the Philippines for 6 years, with one 3 year exit already. Im getting close to another 3 year exit. My visa is always up to date, I make sure to obey the laws pertaining to it. My wife(Filipina) has a passport, but we were married sense then. We traveled together to Hong Kong(unmarried) for my first 3 yr exit. We were informed she cannot exit the Philippines this time, bc the last name is not right.
We are rushing to get her passport updated but the first available meeting (Davao) is in May 13. Then she would have to wait for the passport to arrive. Im not sure that will be in time for my 3 year exit. Is there something else we can do? Her passport is valid, but it does not have my last name.

Hi, My brother-in-law has overstayed his UK tourist visa by about 3 1/2 years due to a mental breakdown whilst travelling. He has only now agreed to return and I am in contact with an immigration lawyer and the British Consult.

His father is willing to pay the fines and deportation fees, along with booking flights etc, as we need to get his back to the UK ASAP for his health (and before this becomes an even bigger problem than it currently is)

He has been told that he may go to prison and may never get out – so is very scared – hence his reticence in reporting to immigration for the past few years.

Can you offer any advice, please?

I am in contact with him and will try to get him to see a doctor and obtain the appropriate medical diagnosis letter.

The consulate says that he will need a fitness to travel letter too, and they have also suggested that a family member may need to visit the Philippines to assume responsibility for local decision making if he is incapable. I presume this would be seen as a positive by immigration services, as there will be someone with him to make sure he leaves the country.

A brief update,

We have contacted a lawyer in Cebu who is willing to assist with the issue – their fee is 1500 USD.

They say that an immigration assessment will need to be completed at a cost of 1950 USD (not sure if this will be extra to any fines at the moment)

Does this sound about right?

Final Update.

The Lawyers were fantastic, dealt with the immigration office and even made arrangements for him to be accompanied to the airport.

We booked the flights and they dealt with the tickets, etc. Very profession and they kept us in the loop at all times.

Fines paid, exit visa arranged.

He is now back home and looking forward to getting well and starting a new life.

I am a Dual citizen (Filipino-Japanese). My PH passport has expired a month ago and I was not able to renew it because getting an identification certificate will take a month. Due to lack of time since my flight is on April 19, I decided not to renew my PH passport. I was informed that I will have to pay an overstay fee if will only use my JP passport. Why do I need to pay an overstay fee when I am a Filipino? If it’s true, how much will it be?

I just wanted you to know that I went to Immigration today and they gave me a Balikbayan Visa. At first, I was told to extend my tourist visa and to pay the overstay fee. However, “with philippine passport” is stamped in my JP passport so extending my tourist visa is not possible. They’ve given me two options instead- to renew my PH passport or to get a Balikbayan Visa. I chose the latter due to time and because they told me that having 2 passports could cause me trouble in the future.

I am a Filipino citizen and was married just last Dec.2018 to a Pakistani National. He is holding a Tourist Visa and we are about to change it into TRV this last Mar.26.
But his visa will be finished by Apr.9, and if we apply for TRV it’s going to be 30days processing.

The immigration advice us that he will be overstayed so it is either my husband will leave the country for a while or we can request an extension and it will undergo legal and will be reviewed by the commissioner our request. My husband just chose the latter and we submitted the documents they asked such as filled up application form, passport copy, marriage cert.
They say we might pay 15,000-25,000. Do we really have to pay that big amount? My husband is not yet overstayed, we are just lack of 15days as per required in processing of his TRV.

Hi.. am foreigner who married Filipina in my country 1987 and with 2 kids with dual passports on 2002 we return Philippines…. they stamp me balikbayan visa 1 year… before expiration next year we been to Intramuros for to get 13A visa as married so i can pay 315 pesos per year…. but they find out that the passport of my wife when enter my country was fake 4 year older coz that time was underage…. so they advise us from immigration not to do anything coz my wife gone face prison….. also we never declare our legal wedding in NSO… my problem is that i want to return back my country…. please inform me how is my status and what i have to pay on my exit? thank you Manuel.

When we issue the passports of my kids in Philippine consulate of my country we declare there our wedding….. but not in NSO…… that means that am tourist..??????? with your fair law before expiration of balikayan stamp am married…. after expiration am tourist……??????

Above was a similar example of someone thinking it is a flight date and not crossing immigratuon point at the airport.
Can you clarify whether it is actually crossing immigration point on the airport or leaving PH physically.

I am married to a korean and my daughter is a korean citizen she is 5 years old, we arrived here in the Philippines on April 5, 2016 and until now we are still here. Now, we will renew her passport and I’m applying again for F6 visa we have all the requirements because my alien card got expired. What does my daughter needs to present for her to leave without any problem? Hi. My partner is an american, I dont know much about his visa thing until I saw his papers. He enters the Philippines 2015, his recent partners never care about these things. He is very sick now. He will be is over staying hera for 3 years or 4 years I think. I wanna know how much would it be to fix things up.
