How much is the Overstaying Fee for Tourists in the Philippines?
Most Tourists to the Philippines are allowed to stay for 30 days before needing to apply for a Visa. The first Tourist Visa extension is the initial extension of twenty-nine (29) days, taking the visit up to 59 days.
This is commonly followed by a two month extension, although some Bureau of Immigration offices allow a 6 month extension.
If a person stay in the Philippines without a Valid Visitor Visa, then penalties are applied, and added to the unpaid Visa fees.
These combined penalties and fees can add up over time and can be something like the following figures:

Note: These are approximate costs. Immigration will determine the exact cost when you visit their office.
A reasonable ‘estimate’ can be made by calculating 3,000 pesos for every month of Overstay. Or about 30,000 for each year.
These figures are approximate calculations based on 2016 fees. They may reduce the cost if they base it on the actual fees dues for older years, which may be less than the 2016 fees.
Charges can also be higher in some cases, such as one example in the comments below:

Financial Penalties for Visa Overstay in the Philippines:
The minimum penalties appear to be:
- All Visa Extension Fees not previously paid.
- Fine for Overstaying – (additional) Php 500.00 per month
- Motion for Reconsideration for Overstaying – (additional) Php 500.00
I have read that the Overstay fee for just a few days would be about 4,000 pesos.
This would be the 3,030 peso first Visa Extension fee + Overstay Fees. (2015 fees)
If the Overstay is for over one month, but less than two months, then I would guess that the fee would be closer to 12,000 peso, made up as follows:
3,030 pesos – First Visa Extension fee
7,340 pesos – Next Visa Extension fee plus the ACR-i card fee
1,000 pesos – Fine for Overstaying (2 months)
500 pesos – Motion for Reconsideration for Overstaying
If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION. The fee would be made up as follows (assume figures for 13 months):
3,030 pesos – First Visa Extension fee
22,490 pesos – Six x 2 month Visa Extension fees plus the ACR-i card fee
6,000 pesos – Fine for Overstaying (12 months)
500 pesos – Motion for Reconsideration for Overstaying
plus maybe one ACR-i card renewal fee

The Official Statement for Visa Extensions is:
Foreigners admitted under Section 9 (a) of the Philippine Immigration Act (PIA) of 1940, as amended, or Executive Order No. 408, as amended, may extend their authorized stay every two (2) months for a total stay of not more than:
– a) Twenty-four (24) months for visa-required nationals; and
– b) Thirty-six (36) months for non-visa required nationals.
The said periods shall be counted from the date of applicant’s latest recorded arrival.
Overstaying Foreigners in the Philippines
Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.
Foreigners who have overstayed for more than twelve (12) months regardless if their stay is within the maximum allowable period or those found to be overstaying by virtue to a complaint or Mission Order regardless of the period shall be referred for deportation.

I am pretty sure they are normally lenient during the COVID times, so you need to get to an office when you can, and sort it out.
I did read that you need to apply for an extension within 30 days after the lockdown is lifted. Otherwise normal rules apply, fines etc.
That should mean you just pay the fines, and leave.

No more quarantine measures, just mainly the vaccine to fly out now. Go talk to immigration, they are pretty understanding. I think you can plead your case if you show the receipt for the online scam to them. Also request a reconsideration for your visa to be updated. You will need to pay overstay fees but you should have time to plan an exit. I would not fear them, just be honest and they should work with you to help you exit. If you have no money, you can declare indigent status. In that case go to your country’s embassy first. Good luck.

Regarding taking a child child and husband to the US, that will depend on Nationality of the child, and if the husband can get the relevant visa for the US.

Immigration will decide if he can renew. As it is under 12 months, it is possible that they will permit this. Passport and completed application form, with photos will be needed. The Immigration office has the application forms, and often there will be a photocopying facility nearby to provide passport copies as required.

Hi i came to the philippinens with my parents (mom filipina dad is german im german citizen) 2012 i was 13 after a year my visa got expire my mom could not renew it coz of finacial problem.. now that my mom just told me that im illegal here and she cant find my passport .. what should i do and how much is my penalty … i wanted to go back to germany for a job.. is there any way i could get out of phil. If you can get Philippine Citizenship (ie: Dual Citizen) that removes the illegal status, and you can use a Philippine passport to travel to many countries without a visa.
Some people use a Philippine passport to fly to Hong Kong, then their other passport (German in your case) to fly to Europe. This avoids any overstay fees on the foreign passport.
You can apply for a replacement German passport at the German Embassy.

A person is an overstayer once their visa validity date has expired.
On entry your visa stamp shows the date you must leave by, or renew before.
Go past that date and you have overstayed.
Your mention of Trial Court, criminal case, seems to have no relevance to this.
However, a visa ‘can’ be revoked for criminal convictions.

They may class that as 1 day over 6 months.

For a visitor visa it should be about 25,000php. It will be the total of all unpaid visa fees, plus the penalties, plus any ACR-I card costs, where applicable.
Just wanna know if one is overstaying for 5years, he lost his passport cause somebody stole his things. He just now fixed his things cause of financial problems. Now his embassy giving him emergency passport. And planning to go in BOI for visa, he plans to go home. Will he still pay for penalties and all? What if he cannot pay all, will they put him in jail? Fees and penalties will still apply. They may ask why the person did not report to Immigration anyway.
Deportation and blacklisting is possible. Confirmation of the reasons from the embassy might mitigate any consequences.

You are currently in the country illegally if you have no valid visa.
The fact that you have married a Filipino is irrelevant, unless you have now got a marriage visa.
You need to get your visa situation sorted before your marriage is complicated by you being deported, and being banned from returning.

Some people have been able to pay the costs at the airport, when it is only one day over. But it would be best to check with your nearest Bureau of Immigration, and ensure that you have no issues at the airport. You don’t want to miss your flight due to delays caused by this.
Extending the visa, at your nearest Bureau of Immigration, is the safest option.

The easy option is just to get a visa renewal, presumably the same as your husband will need to get, before the 30 day initial period ends.
I am assuming the child is travelling on a foreign passport.
You can renew the initial visa for another 29 days.

It must be paid at an immigration office, where the visas will be brought up to date. It can take some hours to sort out, so it isn’t normally done at the airport.
The cost, based on this; “18,000 Total for Up to Six Months Overstay”, should be between 21,000 and 24,000.
Best to take enough to be on the safe side.

If he is travelling on a foreign passport, he will be treated the same as any other foreign passport holder.

However, did he get a balikbayan visa when he arrived. That would give a 12 month visa free stay.

Hi, We have a 30 day visa which shows that the last day in the Phillipines is the 21st of december. If we extend, the last day will be the 19th of January. Our flight leaves the 21st of January. Except for the pricey ACR card or leaving the country in between, are there other options?

You will need to go to an Immigration Office. It may take 24 hours to sort out, maybe more. A 2 year overstay fee is about 60,000

You need passports, youR earlier visa receipts, passport size photos, etc,. Everything you would need for getting a normal visa renewal, and of course your reason for not renewing your visa earlier. This may help when discussing deportation and blacklisting.

If the family member enters the Philippines with a Filipino citizen then they normally give a 1 year Balikbayan visa.
“A foreign national spouse and/or child of a Balikbayan may only be given the said privilege if he/she is traveling with his/her Balikbayan spouse or parent.”
Immigration do say that you can opt for an extension of that visa, at the normal visa extension cost: eg:
“Those who are admitted as Balikbayans are given an initial stay of one (1) year. They may extend their stay for another one (1), two (2) or six (6) months provided that they present their valid passport and filled out the visa extension form and submit it to the Visa Extension Section in the BI Main Office or any BI Offices nationwide. An additional requirement will be ask for Balikbayans who have stayed in the Philippines after thirty six (36) months.”
I have heard that people leave, then return and start again with another 1 year Balikbayan visa.
However, the ruling does say: “A Balikbayan, (ie The Parent) who may be either one of the following:
i. A Filipino citizen who has been continuously out of the Philippines for a period of at least one (1) year;
etc”
It might be best to check with an Immigration office.

A three year overstay is about 90,000 to 100,000 pesos.

I have heard of people that use their Philippine passport to fly to Hong Kong or similar, (using a cheap return ticket) where no visa is required for a Philippine passport holder, then fly from there to the US on the US passport. That gets round any visa issues. It is a nice side trip too.
Otherwise, if using ONLY a US passport, a 20 year visa penalty is very high (around 600,000 pisos).
Some immigration officers have allowed people through when showing both passports, proving both citizenships, but some others insist on using seeing only one passport.
If the Philippine passport has no visd for the US, (which it won’t have being a US citizen) then they get refused boarding.
If the US passport has no valid visa and ECC, then again they get refused boarding, and sent to the city Immigration office.
Confusion on rules in the Philippines seems normal.
You should check at a Bureau of Immigration, and preferably get something in writing to confirm it, if they say you should have no issues.

You need to ask the local Bureau of Immigration about this. Was the child allowed to leave? Blacklisting for a 2 day overstay does seem odd.

If he tries to leave the Philippines as a Japanese citizen, he will be treated as an overstay. If he gets a Philippine passport and leaves as a Filipino, there is no problem.

You need to check this at the nearest Bureau of Immigration. Those travelling only on a foreign passport are treated as foreigners, and need an Exit Clearance Certificate, as well as up to date Visas. You could be looking at around 30,000. But take the birth certificate with you in case they can find a way around the issue for you.

The same as anyone else, get the visa sorted out, ie: brought up to date, pay the penalties, and discuss options with Immigration to see if he can avoid being deported.
If married to a Filipina he should ask about the marriage visa.

The answer may be different, depending on where you are going to. And possible the attitude of the Immigration officer. It isn’t very clear on that.
Going to some other Asian countries, where a visa is not required, you can use your Philippine passport on its own, and avoid any problems.
But, going to the US, and travelling on a US passport, you hit visa issues, where you may be classed as overstaying, and have to leave the airport and renew the visa.
I suggest going to your nearest Bureau of Immigration and getting this cleared, in advance. I have heard of some not being allowed to travel, but of others being allowed to travel with no issues.

You can do 1 month extensions, they are a bit cheaper. It isn’t cheaper to pay the fine, as you will pay whatever is payable for the Visa you missed, PLUS the penalty. A visa can be extended up to 36 months for most people. But only 24 months for some others.

BI fees are nothing more than legalized extortion. The BI is itself a criminal organization since it violates people’s natural right to live, work, and travel wherever they so please (as long as they do not violate anyone else’s property). Immigration laws presuppose that government owns the land. But it doesn’t. Really, to hell with the BI.
The Immigration department gives visas, at what is a small price, to those who wish to live, work, and travel in the country, just like most other countries in the world. No doubt even your own.
Every country has a right to decide who is allowed to enter it’s country.
My brother is a Naturatized US citizen and iwent home to the Philippines last Jan 2017. How much he has to pay for overstaying when he comes back next year in Jan 2019? Also, can he apply for dual citizenship while he is in the Philippines? If he will be granted Dual citizenship, does he still need to pay penalty when he comes back to US by 2019?

If the Overstay is for just over one year, then I would guess that the fee would be closer to 35,000 peso, PLUS possible DEPORTATION, and referral for blacklisting.
It is best to keep your visa renewed and up to date, (to avoid being an illegal alien in the country) especially as you will will have to pay all the missed visa fees one day, plus extra…

Foreigners who have overstayed for twelve (12) months or less but have been in the country beyond the maximum allowable period already may be permitted to update their stay with order to leave the country within fifteen (15) calendar days therefrom and their names may be included in the Bureau’s blacklist upon the discretion of the Commissioner; Provided that, the Commissioner, in the exercise of sound judgment, may allow such foreigners to update and extend their stay taking into consideration their Filipino lineage, medical condition, minority and other analogous circumstances.

Immigration fees are tantamount to extortion, as are all other “mandatory” government fees. To hell with the BI.
I am a naturalized US citizen has been in the Philippines since 2007. I was told many different amount or overstating fees. What would be the estimate fee that I have to pay in order to come back to thr US. thank you in advance
Assuming you haven’t been paying visa fees, for 11 years, it will add up to a fair bit. Based on the quoted figures it will be around 350,000 pisos. You need to do this at a BoI before you leave.

I would suggest asking at a local travel agent that does visa’s if you are unable to find one locally.

My cousin sister is there in the philippines and she pay her penalty visa for 1 year already but she was not able to get it stamped on her passport,due to she lost her passport within that week but now she was able to found her passport again,but then 10 months overstayed now
